The Article 12 and 14 under the current Regulations Concerning the Hygiene Supervision over Cosmetics in China stipulate that, indication for use, promotion of curative effect or medical terms shall not be marked on the labels, small packages or instructions of the cosmetics, and medical functions shall not be promoted in the dvertisement. It is illegal to claim that the products, registered or filed in the name of cosmetics, are “cosmeceuticals” or "medical skin care products”, etc.
In recent years, the popular words "cosmeceuticals" and "drugstore" went viral all over China. But in fact, the so-called "cosmeceuticals" in Chinese people’s mind is simply a market concept, which has no legal basis and is not protected by law.
